Transfer money to eBay?

1 week ago I wrote to someone on eBay that they could get a used ps4 from me for 100 euro. This someone said that he would be in touch next week and look. When he stopped calling, I sold it to someone else. Today I see the man has transferred money to me (with whom I spoke before) but since I can't see his iban anywhere, I can't repay it. When I wrote to the man there was no answer.

what should I do?

He'll probably get in touch

So first of all it is the buyer's job to get back the money he sent you.

but if the buyer doesn't care about getting the money back, it is assumed that he either doesn't care or there are technical problems with your buyer and that he can therefore not contact you.

Try to contact him as much as possible on ebay with the request to repay his IBAN money that he has paid you.

If he does not answer after 6 months, it has long been eaten and then no longer a problem.

Offer + acceptance = legally valid purchase contract according to the German Civil Code (BGB)

When he stopped calling, I sold it to someone else.

So you have 2 valid sales contracts because you did not terminate the first one on time.

Today I see the man sent me money (the one I talked to before)

What the buyer has fulfilled his part of the purchase contract, he is entitled to the PS4.

But since I can't see his iban anywhere, I can't pay it back.

You don't have to either, you have to deliver a PS4.

When I wrote to the man there was no answer.

He'll be in touch, don't worry.

what should I do?

Get an equivalent replacement.

I called my bank advisor and let me know that the buyer did not answer. He said the buyer had to get in touch, otherwise this is a gift for me because he is not allowed to give me the IBAN

Hi! That was probably eBay classifieds right? Basically, I'm at Ratefuchs007: since you have already given the IBAN for payment, you have implicitly concluded a sales contract, the problem is that you have not agreed on a time component and you have not resigned. It actually has nothing to do with the flea market.

In principle, you still owe the handover of the PS4, but the guy has to be countered that he should have made the payment earlier or at least should have informed you after the first week.

What can you do: write to him on eBay and say that after the long time and the unclear statement you no longer expected a purchase and sold the PS4 elsewhere. He should give you an IBAN to which you can transfer the transferred money back. I don't think he'll open a barrel for 100 euro, but he could, you should be aware of that. Greeting

About the present is nonsense, the bank advisor can't say that. The money is due to them, no ifs or buts.
