Cheated on shpock, can I get my money back now?

I bought a ps4 controller at Shpock, the seller called a few markers, such as signs of wear, etc. But otherwise everything would be okay, that sounded good to me and so I bought the controller. When he arrived at my place there were damages that he had not specified, such as that he does not load or the controller does not respond. Thus, I have a defective controller with defects he had not specified. I know that it is a private purchase and you have no guarantee or return right, but he has not indicated all broken and therefore it is fraud and thus I'm right. I've written to you and he says that was the post office and thus he has no fault, but you do not have to be a technician to know that by falling down anything in the charging socket is broken. So I'm right about the fraud. Maybe someone here knows better and can help me what I can do legally now.

If the article differs roughly from the description (he can't fulfill the contract of sale), set him a deadline for the reversal, otherwise you will refund. This is usually enough.
