Bought goods without testing?

I bought an Xbox One on eBay classifieds yesterday. We met at the train station, I paid cash and the buyer assured me that everything would work. Unfortunately, as soon as I connected it, I noticed that the console did not work or did not work. I wrote to the seller and said that I would like my money back. But he says that everything would have worked for him and that he doesn't want to take the console back. What can I do now? Can I go to the police and file a complaint? Will i succeed?

Fa

No, it won't work - you should have tested it

lo

Private purchase = no guarantee and no right of return

Po

Not really? It was already broken when I bought it, but unfortunately I didn't know

Po

But the seller did not indicate a defect. The description stated that everything was working properly

Gu

What can I do now?

Bite the next edge of the table.

Can I go to the police and file a complaint?

No, the police are not responsible for this as this is civil law.

According to the BGB, you as the buyer have the burden of proof that the defect existed before the handover to you, you will not succeed.

Will i succeed?

No, see above.

Gu

And you can't prove it, but according to the BGB you have to.

He

Clear case of the hardship paid.

There's nothing to be done, what exactly is defective on the Xbox?

Repair would still be an option.

I'm an electrician and also like to repair computers and consoles for friends.

Po

Oh darn it. This is very annoying, but thank you for your answer.

Gu

With pleasure.

And I'm sure that this won't happen to you a second time.

Po

Yes, from now on I will extensively test everything electronic before I buy something. : /

Ow

You should have checked - especially when paying cash with a meeting - that everything is in order. Otherwise, m.M.n. Bought as seen.
