I ordered a Playstation 5 from Otto on September 17th. After the order was confirmed, I received notification that I had to make a higher deposit before the goods were accepted as ordered. Said and done. Today I received the notification that the goods were canceled because the goods were sold out.
What can i do now? First and foremost, it's not about the goods, but about the customer deception that I should or should pay for goods that are no longer available.
If someone could help me on this, I would be delighted.
Where do you see the deception? You will get the deposit back.
The deception occurs at the moment when I pay something when the provider knows that the goods are not there. I also had a similar problem some time ago when I was allowed to chase after the canceled deposit for weeks.
There's no deception. On the 17th, the seller was also on a different level of knowledge than today.
On the 17th it WAS still there. Otto can't help it that it's gone faster than expected.
Of course you're angry, I would be angry too.
But the whole thing is not deception
The seller has to "hold back" the goods as long as the down payment has not been made. After all, he also allows a period of time for this, which I immediately followed. As a customer, I first have to assume that the product will also be reserved if I'm asked to pay a deposit.

What makes you think that? Usually, the terms and conditions define the shipping of the goods for delivery confirmation. Before that you will only receive an order confirmation aka. Confirmation of receipt of order.
The period mentioned is for a "hard" cancellation ("no money, no goods"). A "soft" cancellation then also covers something like inventory errors or a defect, because the order picker z. B. The goods fell off.
