As long as you are hacked, there's still a risk that you will be banned. My XBOX 360 was banned, but it had been hacked for over 2 years. Oof

So I can no longer use online functions.
With a 3DS, the online functions are also blocked, so it will very likely be the same for the switch. And as long as the Nintendo Switch is still supported, you could be banned.
