EBay Classifieds: Private Selling - Guarantee Paypal Payments?

I have sold a PlayStation game on eBay and got involved that the buyer pays with Paypal "goods and services". I have withdrawal, warranties excluded.
After a week, the buyer has reported and would like to return the game because he does not like it.
He says through the used Paypal option, my exclusion of return and warranty is void and he has warranty and the legal 14-term return policy. He has now opened a buyer protection case.

is that what he says?

un

That's wrong.

If you have indicated that a return is excluded, then that is it.

Unless the thing is lacking.

Paypal show the ad, so you should be out of the matter.

Did he write in the mail that he does not like the game?

al

Yes he has. And according to the Distance Selling Act, he has the right to return the game, this would be covered by the Paypal option.

Gr

If you have a mail where he writes that he does not like it, then send it to PayPal, which is not covered by a guarantee

Ex

PayPal is not above the law. It can only be that you have to sue from PayPal unlawfully back-booked money from the buyer under civil law.

In addition, there's never a private obligation to repurchase, even by payment via PayPal, provided that the purchased product corresponds to the delivered. The distance selling does not apply to private. Did you say in writing that he does not want to return it because of it? Then simply specify with PayPal. Then even those who could not refund his money. Because that does not correspond to the buyer protection.

Ha

He has now opened a buyer protection case.

Then Paypal will decide it, not you anymore. And Paypal decides in 99% of all cases for the buyer, so that means buyer protection.

is that what he says?

No, because the deadline for opening a buyer protection case is 180 days, not 14.

But you should know all that yourself, since you clicked on the Paypal terms of use and accepted them.

Ri

Write PayPal and show your ad in the stand no withdrawal because private sale.

Ex

The Distance Selling Act does not apply to private.

La

This only affects the seller

al

The question, also for the future, is: Do I have to offer the Paypal option goods and services in principle as a private seller warranty and return even if I do not want that?

al

That means I MUST offer with the option goods and service necessarily take back and guarantee?

al

He says if I offer goods and services as an option, I'm automatically commercial because private sellers are not allowed to offer

Ha

No, this is done automatically by your PP acceptance, as your buyer can open a buyer protection case within 180 days, the PP i.d.R. For the buyer decides.

So why do you offer as a private seller voluntarily (!) PP, pay the fees for it and that too, without knowing what you have since accepted with your check mark?

Ha

No, you should completely refrain from PP!

Ha

Sigh…

Do not you think that you should read the Paypal terms of use at the latest now?

Of course you may also offer that as a private seller!

un

Then he suffered.

un

That's wrong…

un

No, that is not correct.

al

I do not usually do that. The buyer persuaded me and also paid the fees.

un

No, you do not have to.

Assuming Paypal actually decides against you, (I've heard that Paypal sometimes does not look so closely) then you can sue the buyer for fulfillment of the sales contract.

And if you have a legal protection insurance or are low income, I would do that too.

Re

No, you do not have to. PP should you forget synonymous… And eBay classifieds is not made for it.

In a private sale, there's no right of withdrawal for the buyer.
And you have to exclude liability CORRECTLY.

Re

I agree.

In that case, you have the right to sue & probably succeed.
