A few days ago I bought a Nintendo 3DS privately and paid for goods & services via PayPal, i.e. With buyer protection. Then he arrived today.

The device was described as "in perfect condition", which also means that it works without problems.

However, an age restriction with a pin is activated in the device, so that I can neither use the 3D function nor reset the device etc.

So it is no longer fully functional.

I kindly wrote to the shop assistant that the device had arrived, but unfortunately there was a pin lock, which was never mentioned and should please send me the PIN.

Then she wrote that tomorrow she'll see if she still has the pin.

I found that quite astonishing, after all, she should have tested the device for functionality before selling it and noticed that there's this pin lock.

Since I would like to use the full functionality as quickly as possible, I explained to her that there was also the possibility that Nintendo would send a new PIN to her email address and she would then give me this pin. Or the possibility that she gives me the answer to her security question, which she gave as an alternative for the pin.

That would be the quickest and easiest. Since then I have not received an answer and am now quite frustrated because I was really looking forward to the device. I'm also afraid that no answer will come at all.

So and now to the real question:

If I actually don't get an answer (thought so until tomorrow evening), I would like to open a case with PayPal to get my money back. Of course, I would announce this step to her tonight.

How exactly does it work with PayPal, what do I have to consider and when or do I have to send the goods back to them at all? What are the chances of repaying the money?
