I try to describe my incident in as much detail as possible.
I bought a device through eBay classifieds. It's about a "Scuf-Controller" for PS4 and PC. The purchase process went smoothly. I transferred the 85 euro to the seller and the controller also got to me very quickly. I unpacked the controller and was shocked. The seller stated that the controller has hardly been used, is in good condition and works perfectly. But none of it was right. The controller looked badly used. The analog sticks also looked completely different from the pictures, where they look like new. In addition, the controller was partially defective. Both analog sticks only partially work and the L2 button is very loose. I was also very polite to the seller and asked him for an exchange back several times. Every time I tried, I got the same answer: "There's no guarantee and no return in the description". I explained to him that I have the right to a refund if the description does not match the article. Then he just said he had sent the controller as it was in the ad. I don't even know what to do. Go to the police and get advice? Let it be complete? What are my chances? I have the address and name of the seller. I thank you in advance for any helpful answer!
Always make purchases from classified ads using PayPal Buyer Protection. Paypal will keep the money until you approve it and if the goods do not match the description you will get your money back.
would advise you to contact Ebay classifieds:

Telephone: 033203/851555 (Monday to Friday from 10 a.m. To 12 p.m. And from 2 p.m. To 5 p.m.) Fax: 030/308324531. Email: service@ebay-kleinangebote.de. Postal address: eBay Classifieds GmbH, Albert-Einstein-Ring 2-6, 14532 Kleinmachnow.
Unfortunately I paid by bank transfer. I will definitely call tomorrow.
First of all:
eBay classified ads is a regional advertising market that sells goods for cash on collection.
I don't even know what to do. Go to the police and get advice?
Pointless, this is a civil matter for which the police are not responsible.
You can request the seller to take back the controller by registered mail and with a dated deadline; Whether you then go to the lawyer (who you have to pay first) is your decision.
What are my chances?
50:50
I have the address and name of the seller.
Great, that's enough for the registered letter.
And for next time:

Otherwise you could call your bank and ask if you can still withdraw the money.
Why is it so difficult to understand that Ebay Classified Ads is a regional sales platform?
It actually means: someone is listing an item and someone who lives more or less nearby wants to buy this item. You make an appointment, the buyer looks at the item - maybe. If you are still negotiating the price - then you pay and the item is taken away - or not.
The classifieds are not there to have something sent to you - to avoid precisely these problems. There's a lot of buyer protection behind it on Ebay itself - not with classified ads.
And if you also transfer money - firstly you are extremely reckless (because you have no access to it at all) and secondly you do not even have PayPal's buyer protection behind you.
And no, the police won't help you either, because you received the goods. That it is now different than described - would be a problem under civil law.
So you can most likely book that as "apprenticeship" and be more careful in the future.
Transfers can't be "withdrawn" once they have been credited to the recipient's account.
The money will be kept by PayPal until you release it…
That is wrong, the PayPal payer has no influence on a "release".
… And if the goods do not match the description, you will get your money back.
This is also wrong, PayPal does not simply reimburse on demand:
You can open a buyer protection case within 180 days, which PayPal alone then decides on.
And when you report a different item, PayPal usually wants an appraisal (which the buyer can pay for) before anything is reimbursed.
Aren't the costs too high for a lawyer? I'm only 20 years old and a trainee. I guess I can't afford a lawyer.
That's what it looks like.
