Our PS4 Slim, bought at Media Markt, has been sent to Sony for repair twice. Both times, unfortunately, unsuccessful. Allegedly the device was replaced the second time but we still have the same problems.
Since we still have a PS4 Slim and even an older PS4 with us, we have tried this over the same line with the same games and everything went wonderfully. Our colleagues playing the same time at the same time weirdly have no problems even though the Lan connection gives less to those than to us.
Now we were at Media Markt and they want to send in the console one more time. Actually, we're now fed up and would like to withdraw from the purchase.
The console is on 19.05. First 6 months old. We have to get involved. If we get the console back then the first half year is over and the reversal of the burden of proof applies.
After 2 unsuccessful attempts to repair you have the right to change, so withdraw from the purchase and money back.
Even if supposedly an exchange took place? For us, this is not understandable because we have always got the PS4 only in a neutral packaging.
You do NOT need to give more than 2 rectification attempts to the supplier.
That's not what it's all about. Rather, the seller is in spite of two (futile) attempts not able to deliver a faultless product. So, the buyer is now legally able to give the purchased item without ifs and buts and to have the purchase price refunded. This certainly also knows the seller or the management. The knows the BGB.
The is also sent in 100 times. Bought is bought.
What is the mistake? Maybe it's something else. If a replacement device makes the same problems, that is very surprising…
Then look at the serial number of the package and on the device. Are the still identical was replaced nothing.
