Question is above.
I hear on TV every now and then that beats from well-known Deutschrap songs are used and I can hardly imagine that these stations buy so many licenses for? Often there are instrumentals of songs with Spotify. Am I allowed to do this if I run live streams on Twitch in the background?
I think in the Twitch livestream, you can let it run. They have to buy the rights on television.
So yes, let it go. But especially at Twitch there has been a lot of drama lately about videos and clips that have been deleted or even channels that have been blocked.
Of course, the licenses have.
Are of course not license free. Why should they be? Do you have to sing to have rights to your song or what?
Clips are often "censored", which means that the sound is gone at the appropriate places. This will not have legal consequences.
Yes or so. Once I was interested, thank you.
No problem
I don't think the instrumentals unless they come directly from the artist or have been re-loaded
How do you get this idea?
Of course, the instrumental versions of songs are also protected and of course this can be legally pursued.
Can hardly imagine that these stations buy so many licenses for?
Yes, that's exactly what they do.
Am I allowed to do this if I run live streams on Twitch in the background?
If you have secured the rights (usually bought) to be allowed to do so, then yes. If you don't have that, then no.
Will Twitch legally pursue that? - No, because they are not the rights holders. You may take the videos offline or disable the audio track.
The problems you get with the rights holder (musician, label or whoever has the rights to it). They can of course sue you.
This is not legally pursued on Twitch. Clips can be deleted or censored and in the worst case it can lead to a ban, but you won't get any legal problems.
This is not legally pursued on Twitch.
And how do you come to this view? Does the law suddenly stop counting there?
There's a copyright law and that also applies to the Internet.
The legal prosecution of such matters lies with the rights holders, not with Twitch. And of course they can track and warn them. Whether that's on Twitch, Youtube, Facebook or on your own website.
You will be censored, so you will not be able to commit copyright infringements. If the content is copyrighted, the clip will be deleted. This is a protection for the streamers, this filter deletes entire clips if in doubt. How should you be legally prosecuted if you are unable to commit copyright infringements?
