Is there a copyright infringement in the following description?

I streamed on Twitch and someone else recorded parts of my stream and uploaded it to YouTube under his name. He didn't ask me if I agreed and I never allowed him to use this content.

So I want to know if I can report this video to YouTube with a request to delete it for copyright infringement?

Ja

I do not think so. After all, you didn't have your copyright protected. I don't think you will get it automatically.

Ag

If you can somehow prove that the video material is from you then you have a very good chance that the video will be removed when you report it.

lo

I guess so. As far as I know, you can even make sure that you get all the earnings from the video.

I would definitely report!

Ki

Yes, it is not allowed. The question arises whether you have the copyrights to your stream when you show a game for which you in turn may not have any rights…

And as always, this is not legal advice.

Ki

You automatically have copyrights, you don't have to have them protected. You only have to do this for brands and patents and such, for which there are not always copyrights.

Ja

Okay, thank you for the information. But isn't it rather that people on twitch or youtube have the right rights for them? So shouldn't twitch sue him?

Ki

No, you only grant the platform operator the right to distribute your content so that others can also view it.
