When do you get a permanent ban on Xbox?

What must happen that you get a permanent ban on Xbox?

Assuming my account is permanently banned, can I save all my games or is everything really gone?

E.g. If you do a great financial damage to Microsoft. The degree of the ban decides Microsoft.

Then all your digital (not physical) games are gone.
