Is there a way to make debeka pay?

Currently I have the following problem, my landlady and her husband and employees are probably in the evening hours last Tuesday broke in with me and stole my tv and the ps4 pro including some games (damage a total of about 800 euro).

Now, last Thursday, the landlady's husband went downstairs and grabbed the apartment key from my hand and said "if you let me see you again, I'll beat you dead!"

So the burglary and everything has been reported to the police, even the temporary damage to the furniture was reported.

Meanwhile, the whole furniture "lost" because the guy probably threw everything in a container and threw away.

Well, the debeka but said that would pay nothing because the / the perpetrators are indeed known, that can be that ONLY because now pay nothing?

Because the whole insurance (household contents, liability and legal protection) have just completed if I need it and pay for several years since and now I really need them urgently and they refuse "because the perpetrator is known" although there's no 100% evidence for that gives!

What can I do now that the debeka finally fulfills its duties and pays?

If there's no evidence, how can you claim that it was the landlord? The insurance will not pay because you claim to know the offender. Why do not you turn to that?

Le

What does break in you mean?

Was it actually broken or did they use a key?

Go to the lawyer!

And by feeling I would say that the DEBEKA is probably right!

Because you have a direct contact person, the perpetrator, you can bill the damage or sue!

Sa

The whole thing has a background. Could it be that you forgot that you did not pay the rent?

Although that would not change much in the unlawful acts, the matter appears in a different light.

El

It was probably used an illegal third key and then expanded the castle.

However, this was just a guess by the police

El

It's just a suspicion, because I've had problems with the woman for quite some time

Le

But that will be the deciding factor for the insurance, besides the fact that the offender is known.

You have INSURED insured!

If a key is used, that's the sticking point, but it's probably NOT a burglary!

In your terms of insurance, the definition of burglary should be explained. Most of the paragraphs § 3 or § 5 or in the vicinity.

El

The rent was set, but only after almost 3 years, no heating and no hot water more, moreover, the roof was leaking and I had therefore extremely mildew in the apartment.

The landlady knew from the beginning and even made photos of it!

Only this did not do anything.

Sa

That does not matter at first, but it explains in about the actions of the landlord.

You can now indemnify the landlord for damages and hope that brings something.
