There's no company on this planet that really cares about data protection. They would like everyone else to do something with the data. So there's no winner between Sony and Microsoft. The only thing I can say is that Xbox Live is a bit more stable and mature than the PSN.
I chose Sony primarily because a connection from Microsoft to your console would probably be used to display even more personal advertising to you via other Microsoft services and to analyze your data.
Microsoft also belongs to Windows, Bing, etc.
Otherwise I would say the same - both companies take advantage of whatever information they can get from you. Like any major tech company.

Only the companies themselves can tell you that, but no outsiders. I would say Sony collects less because the Japanese have more "honor" than the Americans. But that's just my opinion and in the end both companies operate worldwide, so this statement is probably nonsense.
