In our city there's a drugstore, where you can go skating on Sunday in the backyard, I threw something in the trash, I noticed that the originally packaged PS4 games are in the trash, of course I didn't take any because that would be illegal.
Hence the question.

That they just throw them away is rather unusual. Usually something like this is made unusable.

Sometimes it is cheaper for them if they simply dispose of returns or other goods that fly out of the program (see Amazon). It's not nice, but it's true.
From a purely legal point of view, that would be theft in Germany, since the owner of a thing stays there until the garbage disposal takes the garbage away ^^
Yes, this is illegal, in Germany you own your garbage until the garbage collection picks it up, you also have it in the garbage can, if you take it with you then it is nothing more than simply letting it go out of the store without paying - Theft.
It will then probably have been empty sleeves, such sleeves are not uncommon for retailers because such goods are often stolen. In principle it is easy to open a case, put the contents in your pocket and put the empty case back on the shelf.
Therefore, you usually buy an empty envelope and then pick up your item with the receipt at the output.
