I ordered a PS4 to pick up from Saturn's ONLINE MARKET less than 14 days ago, picked it up and already used it.
Now my question would be whether I should be able to return this to Saturn without further ado.
Basically, because of the current lockdown, it also counts as an online purchase, as I can't look at the goods in the store.
Would the situation change if it was a bundle with an inclusive Fifa CD? (CD unopened)
Thats gonna be close. Normally, the return only applies to goods that have not been "used" more than would have been thrown when checked in the shop.
No, this does not count as an online purchase. You only asked online and it was confirmed that you can pick up the goods. The purchase took place in the store. Everyone should be aware that you can't check the goods in the store more closely at the moment before buying.
According to Paragraphs 312 and 355, products that have been purchased online, by phone or via catalog can be returned up to 14 without a reason. However, I'm not sure whether this applies to used goods
Would it make a difference if I had the goods delivered to me?
Yes, you used the box, so you did more with it than you would have done when you checked the goods in the store
Yes, because that wouldn't be stationary retail. Online you have a legal 14-day right of return.
Every return in store is a goodwill gesture on the part of the company. You don't have to take anything back.
