Yes, it's a gray area, I would say. If you have no vods, where the Twitch filterbot or employees get it, you can theoretically, where there's no plaintiff, there's no judge, they say yes.
However, someone can report you because you are using someone else's music without permission, it is only worse to check because the vods are missing. Seen in this way, you can still get a reminder.
