I ordered three used Nintendo 3DS games on Amazon in December to give them to my brother for Christmas.
The games declared as good or very good were dirty, the covers were broken and one game was defective.
So I arranged a return and used the return label that Amazon provided me with. This was from DHL and had a tracking number. On December 28 The package arrived demonstrably and the refund was also made without any problems.
Today I got the mail that one of the games had allegedly not arrived and that they are therefore debiting the money again. All the games were included in the package as requested by them, which can be proven to have arrived there.
What am I supposed to do now? Can they just pull it off?
In theory, unfortunately, yes.
Can someone testify what you have packed?
You have a receipt, yes. You have proof that something has arrived, yes.
But the evidence only says a package has arrived. It says nothing about the content.
I have someone who was with me when packing, yes. The biggest joke is that customer service confirmed to me earlier that the game was successful but supposedly can't do anything.
Do you have that in writing from customer service?
Yes, stop in the chat. I also made a screenshot of it.
Then you're out of the number. You send the screenshot by email and add:
The statement of your customer service would confirm the complete receipt. So the process is done for me and your bill is unfounded. Should you, despite the confirmation of your customer service, continue to hold on to the claim, I see myself compelled to seek legal help and to have the elements of the offense checked against you in accordance with § 263 StGB.
I ask you to send me the suspension of the claim by email or post within the next 5 working days.
