Ebay classifieds, punishable?

I'm 18 years old and I was lucky enough to get hold of a PlayStation 5. Unfortunately I had to find out that I got the digital version. My money is unfortunately very limited and so I wanted to wait for a PlayStation with a disk version and put the existing PlayStation online.

Unfortunately, I have oriented myself to the Ebay prices and will now supposedly receive an advertisement from the tax office. My question now is: have I made myself a criminal offense?

I'm currently doing my Abitur and am afraid I will have a criminal record for something like this. I'm just in shock and don't know what to do next.

Chat excerpt:

Ebay classifieds, punishable by law
Ro

You don't sell them for commercial reasons, but once as a private person.

I can't imagine what's going to happen.

co

To be honest, I don't understand the problem at all.

Why did you make yourself a criminal offense?

The tax office is not (yet) interested in young people. The tax-free allowance is around 9400 euro, you will not have taken that much

Im

The tax office does not issue any advertisements.

I assume that the price per Playstation is around 600 euro? That makes for sale - fee - price for the new Playstation, if at all, a profit in the 100 range.

Do not think that you have heard from the tax office, but you should point out in your auction that it is a private sale and therefore there's no guarantee or right of return, otherwise you may have to pay for it and, in the event of a guarantee, the money.

I had offered the digital to a buyer for 550 and he asked for my address to pick it up. Then came a text that it was strictly illegal and that I would get a complaint.

Ro

X) he wants to fool you so that he can get the thing cheaper.

Don't believe everything people say on the internet, especially those who want something expensive for cheap x)

mo

It was about 550 euro, the usual standard phrases were also present to the extent that it was a private sale, etc.

The news came from an alleged buyer.

Gu

Stupid stuff, you shouldn't believe everything.

co

Aha. What nonsense. Nothing was illegal there, ok, maybe you were wrong. It can happen.

Ca

They want the thing cheaper that you took at a high price is not illegal.

He is also liable to prosecution for alleging false facts.

Complete nonsense.

I have now added the chat history again without names and dates so that you can better understand the circumstances.

Thank you for all the feedback, that helps me a lot!

Po

Total nonsense what's in the chat.

Two things can be of interest to the tax office:

first: the trade commercially. This can start when you sell 2 of the same things that you bought for the purpose of reselling (profit making).

But reselling a bad buy is a completely normal "private sale transaction" only if a profit of over 600 euro is generated, it would have to be stated in the tax return.

Of course, you can mention the purchase receipt in the description, but this does not mean that the buyer automatically accepts the warranty claims. That is another question; manufacturers naturally want to make reselling more difficult.

Im

Yes of course ignore it

Ro

You really don't need to be afraid, nothing will happen.
